Trademark renewal refers to the process of extending the validity of a registered trademark beyond its initial registration period. Trademark registrations are typically valid for a specified number of years, after which they need to be renewed to maintain their protection and exclusive rights.
It is essential for trademark owners to keep track of their renewal dates and comply with the renewal requirements to maintain the validity and enforceability of their registered trademarks.

Duration of Trademark Registration

Initially, a trademark registration in India is valid for a period of 10 years from the date of application. After the initial 10-year period, the trademark registration can be renewed indefinitely for successive periods of 10 years each.

Renewal Application

To renew a trademark in India, a renewal application must be filed with the Trademark Registry. The application should be filed in the prescribed form, TM-R, and accompanied by the requisite renewal fees.

Timing of Renewal

The renewal application can be filed within six months before the expiration date of the trademark registration or within a grace period of six months after the expiration date. However, a late fee will be applicable for renewal applications filed during the grace period.
